The following terms and conditions apply to Beyond The Scale Group Program hereinafter referred to as the 'Program'

Medical Disclaimer – No Medical Advice

The information and content provided via this Program is for general educational and informational purposes only and is not professional medical advice, diagnosis, treatment or care, nor is it intended to be a substitute therefor. 

You acknowledge and agree that entry into the Program and the presentation of information in the Program does not establish a doctor-patient relationship between us.

If you have any concerns or questions about your health, always seek the advice of a doctor or other qualified health care professional.  Do not disregard, avoid or delay in seeking medical advice or treatment from your health care professional because of something you learned via this Program.

Investment and Payment

Investment:  You agree to pay a total of $997 CAD (which is inclusive of 21% Dutch VAT) either as a single one-time payment or as three payments of $ $333 CAD upon enrollment in the Program.  Your chosen method of payment will be saved and charged 30 and 60 days after you enroll. 

Refund Policy.

As the contents of the Program are a digital product, refunds cannot provided.

Partcipants who enrol in the Program before 12 pm EST on July 29, 2024 are entitled to a one-time money-back guarantee under the following terms

1. Duration of the Money-Back Guarantee

If after completing the Beyond The Scale program, you don't feel that the course information and coaching has improved your relationship with food or improved your understanding of intuitive eating, we offer a money-back guarantee that applies after the completion of the 12-week "Beyond The Scale" course.

2. Eligibility for Refund

To be eligible for a refund, the following conditions must be met:

  • Course Progress: You must have completed at least 80% of the course materials as tracked by course progress in Kajabi.
  • Group Calls: You must have attended a minimum of 8 out of the 12 group calls.
  • 1:1 Call: You must have completed at least one 1:1 call with Jennifer Salib Huber.
  • Written Feedback: You must provide written feedback via a Google form, which consists of 5-10 questions.

3. Refund Process

Refund requests must be submitted in writing within 14 days of the completion of the last group call of the 12-week program. If your refund request is approved, the refund will be processed and returned to you within 10 business days.

4. Exclusions

The money-back guarantee does not apply if the above eligibility criteria are not met. Incomplete submissions or those not meeting the conditions stated will not be eligible for a refund.

  • Your full name
  • Course name (Beyond The Scale)
  • Details demonstrating that you have met the eligibility criteria

Force Majeure

Jennifer Salib Huber Health Consulting and the Program will use its best efforts to provide the services outlined above but it shall not be liable for or failure of performance of, any covenant or promise contained in this agreement, nor shall any delay or failure constitute a default or give rise to any liability for damages if, and only to the extent that, such delay or failure is caused by “force majeure.” As used in this Agreement, “force majeure” means acts of God, acts of the public enemy, acts of terrorism, unusually severe weather, fires, floods, epidemics (excluding the COVID-19 pandemic), quarantines, strikes, labour disputes and freight embargoes, to the extent such events were not the result of, or were not aggravated by, the acts or omissions of the Jennifer Salib Huber Health Consulting. 

Intellectual Property Rights

The Program, and all the material available via the Program are protected by copyright, trademark, or other intellectual property laws.

The Program and material are provided for your informational, non-commercial, and personal use only as authorized under these terms.  You may not use the Program in a manner that constitutes an infringement of my rights or that has not been authorized by me. More specifically, unless explicitly authorized in this Agreement, the Terms of Use, or by the Owner, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any of the material provided in the Program. You may, however, download, store and/or print single copies of any material that is shared with you for your personal, non-commercial use, provided that you maintain all copyright and other proprietary notices.

Limitation of Liability

In no event shall I be liable for damages of any kind, including, without limitation, any direct, special, indirect, punitive, incidental or consequential damages including, without limitation, any loss or damages in the nature of, or relating to, lost business, medical injury, personal injury, wrongful death, improper diagnosis, inaccurate information, improper treatment or any other loss incurred in connection with your use, misuse or reliance upon the Program, regardless of the cause and whether arising in contract, tort, or otherwise. 

I also expressly disclaim any and all liability for the acts, omissions and conduct of any third-party user of the Site or Material, or any advertiser or sponsor of the Site.  Under no circumstances shall I be liable for any injury, loss, damage (including direct, special, indirect, punitive, incidental or consequential damages), or expense arising in any manner whatsoever from (i) the acts, omissions or conduct of any third-party; and (ii) any access, use, reliance upon or inability to use any materials, content, goods or services located at, or made available at, any website linked to or from the Program material, regardless of the cause and whether arising in contract, tort, or otherwise. 

Termination

You may terminate your participation in the Program (and forfeit any remaining sessions) at any time.

I may terminate your involvement in the Program immediately if you breach any of the terms of this Agreement. 

General

Notice.  All correspondence or notice required regarding the Program shall be made using the email address used to enroll in the Program.  Should your e-mail address, billing or contact information change at any time throughout the Program, it is your responsibility to provide your updated information to me within 1 week of any change.

Entire Agreement, Assignment, Survivability and Waiver.  This Agreement may be modified or amended at any time so long as the amendment is in writing and signed by both of us. You may not assign your rights or obligations under this Agreement to anyone else, and the obligations under this Agreement shall survive indefinitely unless otherwise stated in this Agreement. If I choose to waive or not enforce one or more terms of this Agreement, it does not in any way limit my right to later enforce every part of this Agreement. If any section of this Agreement is found to be unenforceable, all other sections shall be held in full force and effect.

Governing Law.  This Agreement shall be construed according to the laws of Den Haag, Netherlands.
