The following terms and conditions apply to The Midlife Feast Community hereinafter referred to as the 'Membership'

Medical Disclaimer – No Medical Advice

The information and content provided via this Membership is for general educational and informational purposes only and is not professional medical advice, diagnosis, treatment or care, nor is it intended to be a substitute therefor. 

You acknowledge and agree that entry into the Membership and the presentation of information in the Membership does not establish a doctor-patient relationship between us.

If you have any concerns or questions about your health, always seek the advice of a doctor or other qualified health care professional.  Do not disregard, avoid or delay in seeking medical advice or treatment from your health care professional because of something you learned via this Membership.

Investment and Payment

Investment:  You can choose either a monthly or annual subscription.

Monthly: You agree to pay a monthly subscription fee of $55 CAD (which is inclusive of 21% Dutch VAT) upon enrollment in the Membership.  Your chosen method of payment will be charged every 30 days unless canceled by you, the user. You can cancel at any time by changing your billing and payment options located in your Kajabi profile. Please note that the billing portion of your Kajabi profile can only be accessed via logging into www.menopausenutritionist.ca/login using a browser, not the Kajabi app. 

Annual: You agree to pay an annual fee of $497 CAD (which is inclusive of 21% Dutch VAT) upon enrollment in the Membership.  Your chosen method of payment will be renewed after 365 days unless canceled by you, the user. You will receive a one-time reminder 7-days before your subscription renews. You can cancel at any time by changing your billing and payment options located in your Kajabi profile. Please note that the billing portion of your Kajabi profile can only be accessed via logging into www.menopausenutritionist.ca/login using a browser, not the Kajabi app. 

Refund Policy.

As the contents of the membership are accessible immediately upon enrollment, refunds are not provided, but you are free to cancel at any time

Force Majeure

Jennifer Salib Huber Health Consulting and the Membership will use its best efforts to provide the services outlined above but it shall not be liable for or failure of performance of, any covenant or promise contained in this agreement, nor shall any delay or failure constitute default or give rise to any liability for damages if, and only to extent that, such delay or failure is caused by “force majeure.” As used in this Agreement, “force majeure” means acts of God, acts of the public enemy, acts of terrorism, unusually severe weather, fires, floods, epidemics (excluding the COVID-19 pandemic), quarantines, strikes, labour disputes and freight embargoes, to the extent such events were not the result of, or were not aggravated by, the acts or omissions of the Jennifer Salib Huber Health Consulting. 

Intellectual Property Rights

The Membership, and all the material available via the Membership are protected by copyright, trademark, or other intellectual property laws.

The Membership and material are provided for your informational, non-commercial and personal use only as authorized under these terms.  You may not use the Membership in a manner that constitutes an infringement of my rights or that has not been authorized by me. More specifically, unless explicitly authorized in this Agreement, the Terms of Use, or by the Owner, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any of the material provided in the Membership. You may, however, download, store and/or print single copies of any material that is shared with you for your personal, non-commercial use, provided that you maintain all copyright and other proprietary notices.

Limitation of Liability

In no event shall I be liable for damages of any kind, including, without limitation, any direct, special, indirect, punitive, incidental or consequential damages including, without limitation, any loss or damages in the nature of, or relating to, lost business, medical injury, personal injury, wrongful death, improper diagnosis, inaccurate information, improper treatment or any other loss incurred in connection with your use, misuse or reliance upon the Membership, regardless of the cause and whether arising in contract, tort, or otherwise. 

I also expressly disclaim any and all liability for the acts, omissions and conduct of any third-party user of the Site or Material, or any advertiser or sponsor of the Site.  Under no circumstances shall I be liable for any injury, loss, damage (including direct, special, indirect, punitive, incidental or consequential damages), or expense arising in any manner whatsoever from (i) the acts, omissions or conduct of any third-party; and (ii) any access, use, reliance upon or inability to use any materials, content, goods or services located at, or made available at, any website linked to or from the Membership material, regardless of the cause and whether arising in contract, tort, or otherwise. 

Termination

You may terminate your participation in the Membership (and forfeit any remaining access) at any time.

I may terminate your involvement in the Membership immediately if you breach any of the terms of this Agreement. 

General

Notice.  All correspondence or notice required regarding the Membership shall be made using the email address used to enroll in the Membership.  Should your e-mail address, billing or contact information change at any time throughout the Membership, it is your responsibility to provide your updated information to me within 1 week of any change.

Entire Agreement, Assignment, Survivability and Waiver.  This Agreement may be modified or amended at any time so long as the amendment is in writing and signed by both of us. You may not assign your rights or obligations under this Agreement to anyone else, and the obligations under this Agreement shall survive indefinitely unless otherwise stated in this Agreement. If I choose to waive or not enforce one or more terms of this Agreement, it does not in any way limit my right to later enforce every part of this Agreement. If any section of this Agreement is found to be unenforceable, all other sections shall be held in full force and effect.

Governing Law.  This Agreement shall be construed according to the laws of Den Haag, Netherlands.
